Equitable Distribution

When a closely held business is an asset subject to equitable distribution in divorce, there are two qualities that the client and his or her attorney require: credibility and timeliness. 

Credibility comes from having the financial experience to properly evaluate the risk and growth prospects of a business and arrive at a reasonable conclusion of value.  It also comes from having the ability to testify to that conclusion in front of a judge or jury in a clear and concise manner.
Timeliness is the ability to work within a sometimes awkward time constraint imposed by court deadlines.  Few courts are sympathetic to unprepared experts.  The valuation report may be completely accurate but will not be worth much if it doesn’t make it into evidence.
